16. RETURN POLICY

16.2. Return Process

If a Customer or Gift Recipient wishes to return a product to the IE 105452242 e-Boutique distribution center, then such person must comply with the following steps:

  1. Call the Client Relations Center to request a Return Authorization Number (RAN). This number is required prior to returning any product originally purchased from the IE 105452242 e-Boutique by Internet or by phone with the Client Relations Center to IE 105452242 ,

  2. Fill out the required information, list the applicable Return Authorization Number (RAN) on the return/exchange form,

  3. Include the completed return/exchange form with the product, all its accessories, the User Guide, the Warranty Card and all other documents, in its original box and delivery package,

  4. Seal the delivery package and affix the pre-paid delivery label to it,

  5. Bring the package to any Fedex location or call Fedex to arrange pick-up.

Should the Customer or Gift Recipient decide to return a purchased item within the 30-day period, IE 105452242 and the Customer or Gift Recipient, as the case may be, agree that IE 105452242 maintains a special interest in the merchandise and will therefore purchase insurance on the returned merchandise. 16.4. Refunds and Merchandise Credit

A Gift Recipient is not entitled to receive a refund. In no event will a merchandise credit be issued by the IE 105452242 e-Boutique distribution center.

Should a product be returned to a IE 105452242 Retail Boutique, the Customer or Gift Recipient are entitled to receive a merchandise credit. No refunds will be issued by a IE 105452242 Retail Boutique; however, a IE 105452242 Retail Boutique can facilitate the return of product to the IE 105452242 e-boutique or Client Relations Center. Please allow up to fourteen (14) business days for full refund, if applicable

If a Customer’s return complies with the return policy, IE 105452242 will use reasonable efforts to credit the refund to the Customer’s credit card or Paypal account no later than fourteen (14) days after receipt of the returned item by the IE 105452242 e-Boutique distribution center. Except for delivery of a defective product, initial shipping charges will not be refunded to the Customer.

 

16.5. Exchanges
Customers and Gift Recipients may be permitted to exchange a product purchased on the Platform ­or by phone through the Client Relations Center for another IE 105452242 product if the product to be exchanged satisfies the conditions of the return policy within thirty (30) days following delivery.

IE 105452242 will send an invoice as a .pdf attachment to the Customer’s email address, which specifies the value of the returned product, the price of the item for which the original product has been exchanged and the difference to be paid by the Customer or the amount that the Customer is entitled to receive, as indicated below.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties in relation to the products and any orders placed through the Platform or Client Relations Center, whether expressed or implied by statute or otherwise or arising from any previous course of dealing or usage or trade practice.

 

Nothing in these Conditions of Sale limits or excludes our liability for any liability which cannot be limited or excluded by applicable law. Subject to the preceding sentence, our aggregate liability to you under these Conditions of Sale for any order whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages shall in no event exceed the one hundred percent (100%) of the price of the product(s) in your order.


21. GENERAL PROVISIONS

If any provision, or part of a provision, of these Conditions of Sale is deemed to be illegal, invalid or unenforceable, the remainder of the provisions of these Conditions of Sale shall be unaffected and shall continue to be fully valid, binding and enforceable.

 

These Conditions of Sale (and associated terms incorporated by reference) constitute the entire agreement between you and us in relation to the order of products or services, and replace and extinguish all prior agreements, draft agreements, arrangements, undertakings, or collateral contracts of any nature made by the parties, whether oral or written, in relation to such subject matter.

 

We are not responsible for any failure or delay in performing or complying with our obligations under these Conditions of Sale which arises from any cause beyond our reasonable control.

 

The waiver by us of a breach of any provision of these Conditions of Sale will not operate to be interpreted as a waiver of any other or subsequent breach.

 

This contract is between us and you. No other person shall have any rights to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will have the benefit of the applicable IE 105452242 Guarantee.


22. GOVERNING LAW; AGREEMENT TO ARBITRATION OF CLAIMS

These Conditions of Sale shall be governed by and construed in accordance with the Federal Arbitration Act and, where applicable, the laws of the State of New York, without reference to conflict of laws provisions. The arbitrator is empowered to resolve the dispute with the same remedies available in court, however, any relief must be individualized to you and shall not affect any other consumer. The arbitration will be conducted in the state and county where you reside (as determined by your address on file with IE 105452242 ) or at consumer’s election, New York, New York, by the American Arbitration Association (“AAA”) under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules.

 

Before bringing any dispute in arbitration, you and IE 105452242 agree that you will first notify the other party and make reasonable efforts for a period of thirty (30) days to resolve amicably any dispute or failure to agree that may arise out of or relate to the product, the Conditions of Sale or any potential or alleged breach thereof. This requirement is a pre-condition, and no claim shall be filed in arbitration (or small claims court) until this provision is first met.

 

MISCELLANEOUS

This agreement shall be governed by and construed in accordance with the substantive laws of Georgia, without any reference to conflict-of-laws principles.

Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of Georgia, to the exclusion of any other courts without giving effect to its conflict of laws provisions or your actual state or country of residence.

The entire agreement between the parties with respect to the subject matter hereof is embodied on this agreement and no other agreement relative hereto shall bind either party herein.

Your rights of whatever nature cannot be assigned nor transferred to anybody, and any such attempt may result in termination of this agreement, without liability to us. However, we may assign this agreement to any person at any time without notice.

In the event that any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.
